Terms And Conditions Of Use

Guerrilla Small Print

Nobody enjoys reading the small print so we have endeavoured to make these TERMS & CONDITIONS as short and simple as possible.

  1. Guerrilla Print for simplicity is hereafter referred to in these terms & conditions as ‘the printer’ and you will be referred to hereafter as ‘the customer’. Print work will be referred to hereafter as ‘goods’.
  2. These conditions shall be deemed as legally binding in any contractual transaction between the printer and the customer. These conditions will apply unless they have been specifically changed in writing to form part of a signed agreement between the printer and the customer.
  3. Any quotation given to the customer in writing will be honoured for 28 days providing these terms and conditions have been complied with. Any additional work requested by the client will be quoted for and charged to the client accordingly.
  4. Any times or dates given for completion or delivery of goods shall be binding on the printer providing all terms and conditions forming the contract are complied with. However if the printer is required to undertake any additional work that was not covered under the original contract this may delay delivery accordingly.
  5. As an exception to Condition 4, the printer cannot be held liable for any delays that are beyond their control. This includes delays caused by defects caused to electronic files or omissions of information, delays approving proofs and non-performance of carriers.
  6. By their nature goods do not have a redeemable value and no refunds or credits for goods correctly supplied will be entertained.
  7. Payment of goods shall be made at the time of order.
  8. No goods will be dispatched until full payment has been made
  9. All quoted prices will be subject to VAT at the current rate when applicable.
  10.  Quality & Liability: Any shortcomings or defects in goods supplied must be notified to the printer within 5 days of delivery. Faulty goods must be returned to the printer for inspection. The printer cannot be held liable in respect of any defect in the goods arising out of the acts, omissions, negligence or default of the customer, its servants or agents including without prejudice to the generality of the foregoing handling and storage of the goods.
  11. The printer cannot be held to be liable for any costs, claims or damage arising out of any act of tort or omission or breach of contract or statutory duty calculated by reference to profits, income production or accruals or loss of such profits, income production or accruals or by reference to accrual of such, claim, damages or expenses on a time basis.
  12. The liability of the printer to the customer for any loss or damage howsoever caused shall be limited to and in no circumstances exceed the price of the goods.
  13. If the customer shall be in breach of any of their obligations under the contract, the printer may (without prejudice to the printer’s legal rights) suspend further deliveries of goods without notice until any defaults by the customer are remedied.
  14. No statement, description, information, warranty or recommendation contained in any catalogue, price list, advertisement, website or communication or made verbally by any of the agents or employees of the printer shall be construed to enlarge, vary or override in any way these conditions.
  15. Whilst the printer will aim to assist the customer, ensuring the artwork is of printable standard is the customers responsibility.  The printer accepts no liability for the quality of printing which is due to poor quality or incompatible artwork.
  16.  Should artwork be unsuitable for printing the printer will contact the customer in order for the customer to correct the artwork and resupply.  Should the customer decide then to cancel the order then there will be a cancellation charge of £15.  A refund will be given minus the cancellation charge.
  17. Any concessions made or latitude allowed by the printer to the customer shall not affect the strict rights of the printer under the contract. If in any particular case any of these conditions shall be held to be invalid or shall not apply to the contract the other conditions shall continue in full force and effect.
  18. The contract shall in all respects be governed by English law and shall be deemed to have been made in England and the printer and the customer agree to submit to nonexclusive jurisdiction of the English courts.
  19. The printer retains all copyright for inclusive design until such time as the customer pays for in full the goods. Upon full payment being received the copyright becomes the property of the customer.
  20. The printer cannot accept any liability whatsoever for any breach of copyright concerning material supplied by the customer and it is the customer’s responsibility to take every reasonable action to ensure no breach of copyright exists.
